Terms of Service

Our TOS hosting agreement is between WebGuruMasters and the person/persons who use our website hosting and domain service. Please read carefully to ensure you understand our terms before purchasing or using any of our products or services.This Terms of Service (“Agreement”) is between WebGuruMasters LLC (“WebGuruMasters”, “we”, “us”, or “our”) and you, the client (“Customer”, “you”, or “your”). By purchasing or using our services, you agree to the terms outlined below.

1. Scope of Services & Client Responsibilities

WebGuruMasters provides only the services specifically listed in the signed agreement or written proposal. We are not responsible for work outside that scope, including third-party tools, mobile app integration, or platforms we do not manage. Clients are responsible for reading and understanding what is included. Disputes based on assumptions or misinterpretations will not be honored.

We provide website hosting, domain registration, and related services at the pricing stated at the time of purchase. WebGuruMasters does not charge hidden fees and reserves the right to modify or discontinue any service at our discretion, in alignment with our values.

2. Account Usage and Limits

Customers are responsible for monitoring their own bandwidth and storage usage. If your usage exceeds the plan limits, we will notify you with options to upgrade or reduce usage. Repeated overages without resolution may lead to account suspension or termination.

3. Billing & Payments

  • All accounts are prepaid. Invoices are issued 3 days prior to the renewal date.

  • A $5 late fee applies if payment is not received within 7 days.

  • Services are suspended after 7 days of non-payment.

  • Monthly plans are non-refundable. Yearly plans include a 30-day money-back guarantee.

  • All promotional plans with free domains are non-refundable, and the domain fee will be deducted from any refund.

4. Cancellation & Termination

  • Cancellations must be submitted through your client portal.

  • You are responsible for all charges incurred until cancellation is confirmed.

  • We may suspend or terminate service without notice if:

    • You violate these terms or the Acceptable Use Policy (AUP).

    • Your content or actions go against our company’s values.

    • We receive a lawful request or order from authorities.

5. Acceptable Use Policy (AUP)

You may not:

  • Engage in hacking, phishing, DoS attacks, or unauthorized access attempts.

  • Host or distribute adult, illegal, or copyrighted content without authorization.

  • Use hosting for bulk email, spam, malware, proxies, or abusive scripts.

  • Violate laws or WebGuruMasters values.

6. Server & Security Management

  • Outdated or exploited scripts will be disabled without notice.

  • Security practices and system integrity are your responsibility.

  • Shared hosting cannot be used for offsite backups or excessive non-website files.

7. Uptime Guarantee

We guarantee 99.99% uptime. Credits are issued as follows if uptime falls short in a given month:

  • 95%–99.9%: 10% credit

  • 90%–94.9%: 20% credit

  • <90%: 50% credit

Exclusions: Maintenance, third-party failures, natural disasters, or policy violations.

8. Support Boundaries

We support hosting issues related to:

  • cPanel access

  • Server-level problems

  • Standard CMS installations

We do not guarantee support for third-party code, custom scripts, or plugin issues, though we may assist at our discretion.

9. Data Ownership and Legal Compliance

You affirm that all hosted files are legal and properly licensed. We will remove content that violates copyright, trademark, or criminal law.

10. Privacy & Customer Data

We protect your personal data as outlined in our Privacy Policy. However, we may disclose your information when required by law or to cooperate with investigations.

11. Restores and Backups

One free site restore is provided per billing cycle. Additional restores are $5 each. Customers are encouraged to maintain their own backups.

12. Domain Registration

Domain purchases and transfers are non-refundable. Domains will only be registered upon full payment. In the event of a payment dispute, WebGuruMasters may retain ownership.

13. Intellectual Property & Caching

You grant WebGuruMasters permission to cache your site content. This does not infringe upon your copyright or trademark rights.

14. E-Commerce Responsibilities

You are solely responsible for compliance, content accuracy, taxes, customer support, and secure handling of customer data for any online store hosted with us.

15. Limitation of Liability

WebGuruMasters is not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the equivalent of three (3) months of service fees paid by you.

16. Indemnification

You agree to indemnify and hold harmless WebGuruMasters against claims resulting from your use of our services, violation of this agreement, or infringement of third-party rights.

17. Changes to Services

WebGuruMasters reserves the right to upgrade, modify, or replace infrastructure without liability for display or performance issues caused by such changes.

18. Force Majeure

We are not responsible for service disruptions caused by events beyond our control, including natural disasters, acts of war, utility failures, or cyberattacks.

19. Governing Law & Disputes

This Agreement is governed by the laws of the State of Maine and the United States of America. Any legal dispute must be filed in Portland, Maine.

20. Amendments

We may revise this Agreement at any time. Continued use of our services indicates your acceptance of the amended terms.

21. Entire Agreement

This Agreement, including the AUP and any service order forms, constitutes the full and binding agreement between you and WebGuruMasters. No oral statements or other documents shall override it.
